The US Justice Department has officially joined a lawsuit brought forward by California Republicans, seeking to prevent the California's recently passed congressional redistricting map.
This legal action, filed in a US district court, challenges the map championed by Governor Gavin Newsom, which was developed in reaction against a GOP redistricting effort in Texas.
"The state's electoral map represents a blatant attempt to seize control that violates civil rights and undermines the electoral system," stated the nation's top law enforcement official.
Democrats have expressed confidence that the new maps will survive court challenges.
"The plaintiffs were defeated in the election and soon they will also lose in court," stated a spokesperson for Governor Newsom.
Legal Basis
The legal challenge claims that California's map improperly used race as a factor to significantly advantage Latino communities in violation of the US Constitution.
"Race cannot be used as a proxy to advance political interests, but that is exactly what the state legislature did with Proposition 50," stated a high-ranking representative from the Civil Rights Division.
Broader Implications
The legal battle represents the major response by Democrats in the ongoing redistricting war that started with Texas and has extended to various parts of the country.
Unlike other states, where Republican state legislatures have enacted gerrymanders, California's plan needed public consent, which it received with approximately two-thirds of the vote.
Wider Consequences
The Democratic party need to flip just a handful of GOP-controlled House seats to gain majority of the House of Representatives in next year's midterm election.
The political group controlling the controlling share will influence the final years of the sitting president's term, deciding if a unified Republican Congress will continue to deliver its political program or face resistance, investigations and possible additional obstacles.
